Do you know which foods are exempt from the FSVP (Final Rule on Foreign Supplier Verification Program)?

May 27, 2017 the Food & Drug Administration will begin implementation of the Foreign Supplier Verification Program also known as FSVP. There are several foods that are exempt which are as follows:

  • Meat, poultry and egg products subject to USDA regulation;
  • Suppliers covered by the seafood or juice HAACP regulations
  • Raw materials or ingredients for use in a food produced under the seafood or juice HAACP regulations
  • Alcoholic beverages
  • Food imported for research or evaluation provided it is not for retail sale, is properly labeled and is accompanied by an electronic declaration at entry
  • Food transshipped through the US for export
  • Food imported for processing and future export

NAFTA Comments are Currently Being Accepted

Lots of “proposed” ideas have been discussed over the past few months. Some key topics have been related to international trade and more specifically some existing and proposed free trade agreements. NAFTA (North American Free Trade Agreement) has been one of the key agreements in question.

The Federal Register dated Tuesday May 23, 2017 has posted notice on this topic. Per regulations, the Office of the United States Trade Representative has posted a “Request for Comments on Negotiating Objectives Regarding Modernization of the North American Free Trade Agreement with Canada and Mexico."

The trade community is encouraged to comment in writing. The U.S. Trade Representative must receive written comments no later than June 12, 2017. There is a specific list of subjects which the U.S. Trade Representative will be accepting comments. The list is included in the Federal Register entry.

Have You Received an Email Offering a Solution to Avoid Anti-Dumping Duties? If So, It Could Be a Scam.

Sample text of scam email:

Dear purchasing manager,

We have been exporting for many years from china, especially USA and Canada. If you need this product, please tell me, so I can quote you.

Please do not worry about dumping duties. This order will be operated through the intermediary trade. We will send the goods to a third country; the forwarder will repack our goods for export with other company title from that third country. It is a legit business.
